General election: IGP assures foreign observers of safety

A company in Lagos has sent a save-our-souls to the Inspector-General of Police, Muhammed Adamu, seeking rescue from the hands of “unscrupulous” officers of the Zone 2 Command, Onikan, Lagos, who have invaded the company and damaged some of its property.


Sunnyvale Nigeria Limited specifically alleged that the Zone 2 police command, under the watch of AIG Lawal Shehu, was working under the instructions of Bembe, who has a pending legal battle to contend with it.
The counsel to the company, Barr. Olayinka Sanni, in a petition to the IGP, alleged that Sunnyvale Nigeria Limited, “hereinafter refer to as our client, is the third Applicant/Respondent in appeal No.CA/L/653/2015, being dissatisfied with the judgements delivered on March 6, 2019. Our client, acting within her constitutional right, appealed to the Supreme Court and same is yet to be fixed for hearing.


“However, Mr. Bembe allegedly took the law into his hands and, without the necessary writ of execution, forcefully entered into our client’s land with thugs and ably assisted by a team of policemen from the Zone 2 Command, Onikan, Lagos. The policemen were deployed by the AIG in charge of Zone 2 without referring to his officer in charge of legal unit, Zone 2, for proper legal advise.


“It is trite law that once an appeal is lodged in a matter, parties are bound to maintain the status quo so as not to jeopardise the efforts of the courts. It is unlawful and condemnable to forcefully take possession without obtaining the necessary writ of possession.”


Citing relevant cases to prove that the police under AIG Shehu and Bembe took the law into their hands, he said, “In Government of Gongola State vs Tukur (1989), LPELR-1335 (SC) Per Obaseki JSC, ‘A stay of execution only prevents the plantiffs or beneficiary of the judgement or order from putting into operation the machinery of the law the legal process of warrants of execution and so forth.’ The police are equally enjoined to follow due process and not to interpret the law to justify a wrong act. The AIG’s act of enforcing a judgement already before the Supreme Court is condemnable and a deliberate act to frustrate the court.


“Sir, your urgent assistance is needed to curb the excesses of AIG Zone 2 who is directly acting to the script written by Mr. Bembe without regard to the good image the present police administration is building. Your urgent intervention now to forestall a breakdown of law is needed by immediately withdrawing the policemen deployed on the property in dispute”, he pleaded


Reacting, AIG Shehu denied the allegations, describing them as untrue .
Shehu, who spoke through the command’s public relations officer, CSP Dolapo Badmus, said, “The AIG is a man of integrity. It is not true. It is not possible for the AIG to detail policemen to accompany thugs to take possession of a property. He has told me to tell the aggrieved person to come to his office and make official complaints as his door is open. He is not aware of what he is accused of.”
